General Rental Terms and Conditions

These general terms and conditions include the fundamental contractual and rental provisions that apply when you enter into a business relationship with us.

1. Scope and Contractual Relationship
1.1 Contracting Parties
These rental conditions govern the legal relationship between the renter (hereinafter referred to as "Renter") and Eitzinger Sports S.L. (hereinafter referred to as "Lessor") for the rental of bicycles, unless these are part of a package arrangement.
1.2 Duration of Contract and Liability for Delay
The rental agreement is concluded for a fixed period. An implicit extension due to late return is excluded. If the Renter fails to return the bicycle after the agreed rental period—whether through fault or not—the Lessor may charge a usage fee of at least the agreed daily rental rate. Further compensation claims remain unaffected in case of culpable delay.
1.3 Early Return
If the Renter returns the bicycle before the agreed end of the rental period, there is no entitlement to a refund of the difference.
1.4 Cancellation by the Renter
The Renter may cancel the booking free of charge up to 7 days before the start of the rental. For later cancellations, the following fees apply:
- 50% of the total rental fee for cancellations made within 1–7 days before the rental start.
- 100% of the total rental fee for same-day cancellations or no-shows.
1.5 No-Show Policy
If the Renter does not show up at the agreed rental time and does not notify of any change or cancellation, this counts as a no-show. In such cases, the Lessor may re-rent the bicycle to a third party 24 hours after the original booking start without informing the Renter. No refund will be issued, even if the bicycle is rented to another customer in the meantime.
1.6 Rebooking by the Renter
A change in the rental period is possible if requested at least 7 days before the original start date. A processing fee of €20 will be charged. For changes made within 7 days of the rental start, the cancellation terms under section 1.4 apply
1.7 Rebooking by the Lessor
The Lessor reserves the right to modify or cancel the booking for valid reasons (e.g., unavailability due to repairs or force majeure). In such cases, the Renter will be offered an equivalent alternative or receive a full refund of any amount already paid.
1.8 Cancellation Fees and Exceptions
Cancellation or rebooking due to force majeure (e.g., travel restrictions caused by natural disasters or pandemic-related measures) will not incur cancellation fees. The Renter must provide appropriate evidence.
1.9 Refunds
Refunds will be issued within 14 business days after receipt of the cancellation or rebooking request. The refund will be made to the original payment method.
2. Use and Return of the Bicycle / Damage Notification and Other Obligations
2.1 Condition and Use of the Bicycle
The Lessor provides the bicycle in technically sound, roadworthy, and clean condition. The Renter agrees to use it appropriately and carefully, following traffic regulations. Use under the influence of alcohol or drugs is prohibited. Technical modifications or changes to the bicycle are not allowed. Attachments such as triathlon bars are used at the Renter’s own risk; the bicycle must be returned in its original condition. Use of the bicycle on sand (e.g., beach, dunes) or in proximity to the sea (e.g., shoreline, saltwater-exposed areas) is strictly prohibited. Damage caused by contact with sand, saltwater, or moisture is not considered normal wear and tear and is the Renter’s liability under section 3.1.
2.2 Damage Notification
All damages to the bicycle—regardless of fault—must be reported immediately to the Lessor. The Renter is obliged to provide full details of the incident. If the bicycle is no longer roadworthy due to the damage, a comparable replacement will be provided. Liability provisions in section 3 remain unaffected.
2.3 Bicycle Exchange
If the Renter requests to exchange the bicycle, a processing fee of €10 will be charged unless the exchange is due to a pre-existing defect. If the new bicycle is in a higher price category, the difference must be paid. No refund is given if switching to a lower category.
2.4 Theft or Accident
Reporting Obligation In the event of theft or an accident, the police must be notified immediately with the involvement of the Lessor. The Lessor must also be informed immediately. Failure to comply results in liability for consequential damages.
2.5 Return
The bicycle must be returned to the rental station on the last rental day during opening hours in the same condition as received, aside from normal dirt. Final cleaning is included in the rental price.
3. Renter’s Liability
3.1 General Liability
The Renter is liable for all personal and property damages caused during the rental period, including in cases of negligence, gross negligence, or intent. The Renter is particularly liable for bicycle damage, loss, and breaches of contract. If the damage caused by the Renter leads to a loss of use (e.g., due to extended repairs), the Renter is liable for the corresponding rental loss (based on the regular rate for additional days). In case of total loss, liability is based on the current sales price of the respective model according to the Lessor’s price list, minus the rental fee already paid. In cases of gross negligence or willful damage, repair and replacement costs must also be covered. Further damage claims remain unaffected.
3.2 Liability for Theft or Loss
The Renter is liable for the loss or theft of the bicycle at the current sales price according to the Lessor’s price list, minus any rental fees already paid. This liability limitation does not apply in cases of willful misconduct or gross negligence.
3.3 Reimbursement of the Liability Amount
If the bicycle is recovered after theft and is in a condition deemed rentable by the Lessor at their reasonable discretion, the Lessor will refund the liability amount in accordance with section 3.2. The Lessor applies professional judgment and may share the reasoning with the Renter as a gesture of goodwill.
4. General Provisions and Applicable Law
4.1 Written Form, Completeness, Severability Clause
The contract is subject to the written form. Changes or additions must also be in writing. Verbal agreements do not exist. The legal invalidity of individual provisions does not affect the validity of the remaining terms.
4.2 Applicable Law and Jurisdiction
This contract is governed by Spanish law. The courts at the Lessor’s registered office shall have exclusive jurisdiction for all disputes arising from or relating to this agreement.
4.3 Set-Off
Offsetting against claims of the Lessor is only permitted with undisputed or legally established claims of the Renter.
